This privacy policy (“Privacy Policy”) sets out the manner in which Ezymind Healthcare Private Limited (“Company” or “we” or “our” or “us”) collects, uses, processes, shares, transfers, discloses, and safeguards your personally identifiable information, including any data that identifies, relates to, describes, or is reasonably capable of being associated with you, whether individually or in combination with other information accessible to us (“Personal Information”) when you visit the website www.getinnergize.com and any associated applications, including but not limited to Innergize App (collectively, the “Platform”).

 

1.                  By accessing or using the Platform, you expressly consent to the collection, use, processing, and disclosure of your Personal Information in accordance with the Privacy Policy, or as otherwise required by, or permissible under, applicable law. In the event you do not provide such consent, you are hereby advised not to access or use the Platform.

 

2.                  The Company does not knowingly collect, solicit, store, or process any Personal Information from individuals under the age of 18 (eighteen), nor does it intentionally permit such individuals to register for or use any of the products or services offered on the Platform, including but not limited to product purchases, service feedback, or participation in Platform activities. The Platform is not directed towards, nor intended for, individuals under the age of 18 (eighteen). If you are under 18 (eighteen) years of age, you are hereby advised not to access or use the Platform or provide any Personal Information without verifiable parental or legal guardian consent. The Company reserves the right to request written confirmation of such consent where applicable. In the event a parent or legal guardian authorizes a minor’s use of the Platform, such parent or guardian shall be deemed responsible for the minor’s conduct and usage, and all provisions of the terms of use of the Company and this Privacy Policy shall apply to them jointly and severally.

 

3.                  The Company may collect Personal Information that you voluntarily provide when registering on the Platform, expressing interest in our products or services, participating in activities, or otherwise communicating with us. The scope of such information depends on your interactions and may include, without limitation: (i) business and personal contact details (e.g., name, email, phone number, mailing address, company, and professional title); (ii) account credentials and profile preferences; (iii) your account creation on the Platform; (iv) feedback and correspondence; (v) demographic data (such as age and location); (vi) financial details required to process payments (processed and stored by third-party providers, subject to their privacy policy); (vii) precise geolocation data (if authorized); (viii) transaction and usage history; (ix) marketing preferences and engagement data; and (x) content submitted through the Platform. The Company may also collect information from social media platforms and other third-party sources such as business partners, marketing affiliates, or publicly available databases. All such information shall be used in accordance with this Privacy Policy or as otherwise disclosed at the time of collection. You are responsible for ensuring that the information provided to the Company is true, accurate, complete, and kept up to date.

 

4.                  When you access, use, or navigate the Platform and any associated features, functionalities, content, or other services made available through it, certain technical and usage-related information may be collected automatically. While this data does not directly identify you (such as by name or contact details), it may include your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, geolocation data, and information regarding how and when you interact with the Platform. This information is primarily collected to ensure the security, functionality, and proper operation of the Platform, and to support internal analytics and reporting purposes. Such data may be gathered through cookies and similar tracking technologies. Categories of automatically collected data may include: (i) log and usage data, including timestamps, accessed features, pages viewed, error reports, and diagnostic details; (ii) device data, such as IP address, device identifiers, browser type, hardware model, carrier, and configuration settings; and (iii) location data, which may be collected through GPS or inferred via IP address, subject to your device settings. Disabling location access may limit certain features or functionalities of the Platform.

 

5.                  The Company may process your Personal Information for various lawful purposes, depending on your interactions with the Platform. These purposes include: (i) operating, maintaining, and improving the Platform, including enabling social features, providing customer support, and communicating with you regarding events or contests; (ii) facilitating account registration, authentication, and overall account management; (iii) conducting research and development activities to enhance existing Platform and develop new offerings by analysing usage trends and user demographics; (iv) sending marketing and promotional communications related to the Company and its affiliates, subject to applicable law and your right to opt out; (v) displaying targeted advertisements in collaboration with third-party advertising partners, based on your usage, interests, or location; (vi) complying with applicable legal obligations, including responding to lawful requests and regulatory or governmental inquiries; (vii) ensuring compliance, detecting and preventing fraud, safeguarding rights and property, and investigating or deterring unethical or unlawful activities; (viii) delivering or facilitating delivery of requested products or services; (ix) responding to user inquiries and resolving Platform-related issues; (x) communicating administrative updates, including changes to terms, policies, or offerings; (xi) fulfilling and managing orders, payments, returns, and related transactions; (xii) enabling communications between users where permitted; (xiii) soliciting feedback to improve Platform quality; (xiv) maintaining the security and integrity of the Platform, including fraud detection; (xv) identifying patterns of Platform usage to improve Platform quality; (xvi) evaluating the effectiveness of marketing and promotional efforts; and (xvii) processing information where necessary to protect the vital interests of individuals, including the prevention of harm.

 

6.                  The Company may process your Personal Information based on one or more of the following lawful grounds, as permitted under applicable data protection laws: (i) consent, where you have voluntarily provided clear and specific permission for your Personal Information to be used for a defined purpose, which consent may be withdrawn by you at any time without affecting the lawfulness of processing carried out prior to such withdrawal; (ii) performance of a contract, where such processing is necessary for the performance of a contract to which you are a party, or to take steps at your request prior to entering into such contract; (iii) legitimate interests, where the processing is necessary to pursue our legitimate business purposes, provided such interests are not overridden by your fundamental rights and freedoms; (iv) compliance with legal obligations, where the processing is required to meet our legal or regulatory obligations, including cooperating with lawful requests from government or regulatory authorities, asserting or defending legal claims, or complying with judicial proceedings; and (v) vital interests, where the processing is necessary to protect your life, health, or safety, or that of another individual, particularly in circumstances involving an imminent risk of harm.

 

7.                  The Company may disclose your Personal Information to third parties under certain circumstances, as permitted by applicable law and in accordance with this Privacy Policy. Such disclosures may include: (i) service providers, including third-party vendors engaged to perform functions on our behalf, such as hosting, customer support, analytics, marketing, email delivery, and database management who are contractually bound to use the information solely as instructed by the Company and not for any unauthorised purpose; (ii) payment processors, whereby all payment-related information is collected and processed directly by our third-party payment processor, which complies with applicable data security standards and processes such information in accordance with its own privacy policy, while we do not store or access full card details; (iii) legal compliance, fraud prevention, and safety, where disclosure is necessary to comply with legal obligations, enforce the rights of the Company, prevent fraud, or protect the safety of any person; (iv) business transfers, involving any merger, acquisition, reorganization, financing, or sale of all or part of the business or assets of the Company, in which your information may be disclosed or transferred as part of such transaction; (v) use of Google maps platform application programming interfaces (“Google Maps APIs”), where information, including shipping and billing addresses or other location-specific data, may be shared via Google Maps APIs, and such information may be cached on your device for a limited period, subject to Google’s privacy policy and applicable consent mechanisms, including the ability to revoke consent at any time; and (vi) affiliates, including parent company, subsidiaries, and affiliated entities of the Company under common ownership or control, who will be required to process your Personal Information in a manner consistent with this Privacy Policy.

 

8.                  The Company may use cookies and similar tracking technologies, such as web beacons and pixels, to collect, store, or access certain information in order to enhance and personalise your experience when using the Platform. When you visit the Platform, cookies may be placed on your device, subject to your prior consent where required by applicable law. A consent prompt will be displayed to inform you and request your acceptance before deploying such cookies. You have the option to refuse consent, however, doing so may affect the functionality or performance of certain features of the Platform. Most web browsers are configured to accept cookies by default, but you may modify your browser settings to disable or manage cookies at your discretion. For guidance, you should refer to your browser’s help menu. The cookies used may include: (i) strictly necessary cookies that enable functionality such as displaying content in expandable or collapsible formats; and (ii) analytical cookies, such as those deployed through Google analytics, which collect aggregated and anonymised data regarding user activity, including time spent on pages and overall usage patterns, for the purpose of evaluating and improving the performance of the Platform. You may delete cookies at any time; however, this may result in the loss of certain preferences or quicker access settings previously enabled for your use of the Platform.

 

9.                  The Company will only keep your Personal Information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). No purpose in this Privacy Policy will require the Company in keeping your Personal Information for longer than the period of time in which users nave an account with the Company. When the Company has no ongoing legitimate business need to process your Personal Information, the Company will either delete or anonymise such information, or, if this is not possible, then the Company will securely store your Personal Information and isolate it from any further processing until deletion is possible.

 

10.               The Company has implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your Personal Information, no electronic transmission over the internet or information storage technology can be guaranteed to be 100% (one hundred percent) secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your Personal Information. Although the Company will do the best to protect your Personal Information, transmission of Personal Information to and from our Platform is at your own risk. You should only access the Platform within a secure environment.

 

11.               Under applicable data protection laws, you may be entitled to exercise certain rights concerning your Personal Information, including the right to: (i) request access to and obtain a copy of your Personal Information; (ii) request correction or deletion of inaccurate or outdated Personal Information; (iii) restrict or object to the processing of your Personal Information in certain circumstances; and (iv) where applicable, request portability of Personal Information. You may exercise these rights by contacting the grievance officer details of which are outlined in Paragraph 14 below. All such requests will be considered and addressed in accordance with applicable legal requirements. Where the processing of your Personal Information is based on your consent, whether express or implied, as permitted by law, you have the right to withdraw such consent at any time without affecting the lawfulness of any processing conducted prior to such withdrawal or, where permitted by law, processing based on other lawful grounds. You may opt out of non-essential promotional communications by using the unsubscribe option provided. Further, you will continue to receive essential communications related to your account, including but not limited to, security alerts, policy updates, and transaction notifications which cannot be opted out. To review or amend your account information, or to request deactivation or deletion of your account, you may contact the Company using the information provided or update your preferences via your account settings. Upon such a request, the Company will delete or deactivate your account from active systems, though certain information may be retained as necessary to comply with legal obligations, resolve disputes, enforce our terms, or detect and prevent fraudulent activity. Regarding cookies and similar technologies, most web browsers are configured to accept cookies by default; however, you may modify your browser settings to decline or delete cookies. Please note that disabling cookies may impact the functionality and performance of certain features of the Platform.

 

12.               Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that the Company must follow in the future, the Company will inform you about that practice in a revised version of this Privacy Policy.

 

13.               The Company reserves the right to modify, update, or amend this Privacy Policy at its sole discretion from time to time in order to reflect changes in applicable legal or regulatory requirements, technological advancements, or modifications to its data processing practices, services, or product features. Any such amendments shall become effective upon being published on the Platform. Your continued access to or use of the Platform, products, or services following the publication of any changes shall constitute your acknowledgment, acceptance, and agreement to be bound by the revised Privacy Policy.
